This Disclaimer ("Disclaimer", "Policy") governs your use of any and all cannabis-infused products, edibles, treats, condiments, drinks, syrups, powders, and other related items ("Products") provided, sold, or distributed by Wonky’s Edibles, located at 2595 East Chandler Ave. #4, Las Vegas, NV 89102 (“Company”, “we”, “us”, or “our”). By purchasing, consuming, using, or distributing our Products, you (“Customer”, “User”, “You”) acknowledge and agree to all terms and conditions within this Disclaimer.

GENERAL DISCLAIMER

All Wonky’s Edibles products are offered “AS IS” and “AS AVAILABLE,” without any warranties of any kind, express or implied. Use of our products is at your own risk. You agree that you are solely responsible for your health, safety, decisions, behavior, and actions resulting from the purchase or use of our Products.

1. NO MEDICAL ADVICE OR GUARANTEE OF EFFECTS

Our products are not intended to diagnose, treat, cure, or prevent any disease.
The effects of cannabis-infused products vary significantly by individual and are not guaranteed.
No content, label, description, or claim made by us shall be interpreted as medical, therapeutic, or psychological advice.
You should consult a licensed medical professional before using our Products, especially if you are pregnant, nursing, have any medical condition, or are taking any prescription medications.
We do not guarantee any medical, mental, or emotional outcomes from using our Products.

2. AGE AND LEGAL COMPLIANCE

Our Products are intended only for individuals 21 years of age or older.
By using our Products, you affirm that you are of legal age and that cannabis-infused product use is legal in your state, city, or jurisdiction.
We disclaim any liability for use in locations where cannabis or THC is restricted or prohibited by law.

3. PRODUCT CONTENT, DOSING, AND SENSITIVITY

All Products are infused with cannabis oil with a minimum potency of 80% THC, and each unit contains 10mg THC unless otherwise stated.
Individual tolerance, sensitivity, metabolism, or health conditions can dramatically affect your experience and risk.
Overconsumption may result in anxiety, hallucinations, paranoia, nausea, or medical emergencies.
We are not responsible for any adverse reactions due to miscalculating dosage, combining with other substances (e.g., alcohol, prescription drugs), or failing to wait adequate time before redosing.

4. INTERACTIONS WITH MEDICATIONS OR CONDITIONS

We expressly disclaim any liability for complications or consequences that arise due to such interactions or pre-existing conditions.

5. OPERATING VEHICLES OR MACHINERY

Do not drive or operate heavy machinery while under the influence of our Products.
We shall not be liable for any accidents, injuries, fatalities, property damage, or criminal charges resulting from impaired behavior after use.

6. WORKPLACE, EMPLOYMENT, AND TESTING

Use of our Products may cause a positive result on drug screenings, employment drug tests, or legal screenings.
We are not responsible for job loss, demotion, disqualification, or legal consequences resulting from THC detection.

7. STORAGE, CHILD SAFETY, AND PETS

Products should be stored out of reach of children and pets and in accordance with local laws.
We are not liable for accidental ingestion, poisoning, harm, injury, or death resulting from improper storage or unauthorized use.

8. PRODUCT MISUSE AND MODIFICATION

Any modification, alteration, or combination of our Products with other substances (whether legal or illegal) voids any implied safety or efficacy.
Misuse includes but is not limited to: excessive consumption, melting, re-cooking, injecting, inhaling products not intended for smoking, or any other unintended use.
We are not liable for any outcomes resulting from the abuse, misuse, or creative repurposing of our Products.

9. DELAYED OR CUMULATIVE EFFECTS

Effects of THC may be delayed by several hours and may intensify over time.
We disclaim any responsibility for delayed onset, misjudgment of dose, or stacking of multiple servings.

10. THIRD-PARTY ACTS OR DISTRIBUTION

We are not responsible for any actions taken by third parties, unauthorized resellers, or distributors.
If you resell or share our Products, you do so at your own legal and civil liability and agree to indemnify and hold us harmless.

11. PACKAGING, LABELING, AND COMPLIANCE

We make every effort to comply with packaging and labeling requirements in Colorado, California, and Nevada.
However, we are not liable for misinterpretation, damage, or tampering that occurs after the Product leaves our possession.

12. LOST, STOLEN, OR DAMAGED ITEMS

We are not responsible for Products that are lost, stolen, melted, broken, improperly stored, or otherwise rendered unusable after shipment or purchase.
All shipments are at the buyer’s risk unless additional shipping protection is purchased.

13. FORCE MAJEURE

We are not liable for any failure or delay in delivery, use, or satisfaction of our Products due to acts of God, pandemics, governmental actions, supply chain disruptions, weather events, or other uncontrollable circumstances.

14. NO WARRANTIES OR GUARANTEES

NO WARRANTIES are made regarding effectiveness, enjoyment, duration of effects, consistency, flavor, or satisfaction.
Use of our Product is entirely voluntary and done at your sole risk.

15. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Wonky’s Edibles, its owners, employees, affiliates, officers, and agents from any claims, actions, lawsuits, damages, liabilities, injuries, expenses, or losses (including attorneys’ fees) arising from:

Your purchase or use of our Products;
Any distribution or resale of our Products;
Any violation of this Disclaimer or local/state/federal laws;
Any injuries or damages caused to third parties or property;
Any false representation or misuse by you or on your behalf.

16. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Wonky’s Edibles shall not be liable for any direct, indirect, incidental, punitive, consequential, or special damages whatsoever arising from or related to:

Use or misuse of our Products;
Failure to achieve intended results;
Product defects (except where required by law);
Physical, emotional, psychological, or financial harm;
Accidental or intentional ingestion or exposure.

If liability is found, damages shall be limited to the purchase price of the Product.

17. GOVERNING LAW AND JURISDICTION

This Disclaimer and all disputes arising out of or relating to our Products shall be governed by the laws of the State of Nevada, without regard to conflict of laws. You consent to personal jurisdiction in Las Vegas, Nevada, for any disputes.

18. MODIFICATION OF THIS DISCLAIMER

We reserve the right to update, revise, or replace this Disclaimer at any time. Your continued use of our Products constitutes agreement to the current version.

By purchasing or using any Wonky’s Edibles Product, you acknowledge that you have read, understood, and agreed to this Disclaimer in its entirety.
